So… I’ve been combing through the pages of this thread after getting the run around from my dealer. On 5/27/23, I bought my wife a 23 Explorer Timberline from a local dealer here in WV. Apparently our vehicle is affected by this recall and was under stop sale…. However, the dealer allowed us to take possession of it prior to being repaired. So apparently we should have never taken possession and it’s still showing in the dealers inventory. I found this out when I tried to purchase an ESP from Flood Ford and they told me it couldn’t be applied. So now I’m stuck wondering what my options are and what kind of recourse/action I can take.

I’m going to explore my options. Not sure what to do at this point. It appears the dealer broke a federal law by selling the vehicle since it was under stop sale. We already have over 3k miles on it and the vehicle we traded in is long gone. We like the Explorer, but this is very frustrating and something needs to be done.
Well, if Motor Trend knew everything, they would have lots of info to also guide us with our Stop Sale problem now, wouldn‘t they?
Let me change my tone over to yours; you shit on a fellow forum member trying to offer advice to someone moving to a platform with issues, with your toilet bowl know-it-all attitude, and go off on a verbal bender on how much you hate your Explorer, in thread geared towards new or existing members going nuts waiting on their new cars, in some cases at a personal loss or a very large inconvenience. How about you take your trash talk elsewhere? I know plenty of folks with new and old Kia/Hyundai models that have just as many problems, or worse, than you did. Although I would usually feel sorry for someone who had issues such as yours, in this case I’m more inclined to suggest that you find the door and get out of here.

If you enjoy the car, I would keep on driving until the fix is applied. The ESP should be available to buy until end of factory warranty (at least it had been possible to buy an extended in the past in Canada). A lot of us envy you on the fact that you have your car!

Ask me about how I feel about Toyota, which is supposedly “the” most reliable out there and lost its valve seals at 3k on a brand new car early this year. Good luck… sadly poor quality is the norm and it is a bit like bad dating advice that I was given years ago - “all girls are crazy - just find the one that is the least crazy to you”. They did not factor in that I am somewhat off myself :-o
Looking at Grand Cherokees here as they might have infotainment issues, and electrical, and bad paint, but you can plow one through just about anything and get from point A to point B without issue. I used to have an Overland and even though it had its gremlins, I made it through anything that I tossed at it - typically doing rescue for workers who got their work trucks stuck in inclement weather, lol!

We are definitely enjoying the vehicle. The issue becomes the pricing of the ESP. I believe the longer you wait, the higher the price is. I believe the price remains the same for the first few months and then increases. Additionally, ESP pricing is supposed to increase Sept 1st and I was trying to purchase it at the lower cost now. Just frustrated finding out we were allowed to buy a vehicle under stop-sale and it appears the dealer knew it shouldn’t have been sold.
I see your dilemma for sure, but I also agree with Jerbroni. Would you rather have been told you could not take possession of your Timberline? In that sense, you got lucky. I would have some confidence that once the fix is released and your car is reported to Ford corporate as being in your possession, you could work out a deal on the extended warranty pricing. Your problem is kind of the opposite of several people on here who were not allowed to take possession of their ST's even after purchasing, or like myself who ordered them and are waiting indefinitely on them to ship out... but it's also kind of exactly the same because in the end, this stop sale has caused us all unnecessary problems, one way or another! I hope it all works out for you with the extended warranty. In the meantime, enjoy your Explorer!
I hear you… maybe try getting it registered when the dealer marks the car as sold, since they cannot do it now anyway? Call it an offer to back date the ESP by the selling dealership at time of sale, not at time of deal closing. Technically you could just say that price paid is that which you were quoted when signing 
I've had many Grand Cherokee SRT's and that was one of the reasons I chose the ST, because I throw a tune in it and I'm at 500 horsepower without spending $100 k on a SUV. A comparable Durango would cost me a $100 k even at my employee price. What most people don't know is that the Grand Cherokee comes with 3 years oil changes and tire rotations no cost, it's a bit of an added bonus.
I have some possible good news for those of us waiting on Explorers that have been stuck in Chicago.
I have been waiting on a dealer ordered ST that went into production on May 3rd. Since that time the order status page continued to list it as "In Production" and the "Last updated" date remained fixed.
I was also watching another ST that my dealer had ordered on the same day as mine, but that one went into production on 4/29. Like mine there had been no updates on the status.
The good news is that I noticed today that both tracking pages were updated on 8/22 and this second ST had it's status updated to "shipped"
I am hoping that this means they have started to apply the final fix to the Explorers that they have been holding.

I own a 2017 Jeep Grand Cherokee Altitude. I love that car. The ST will be an additional vehicle for my husband & I. I was on the fence about trading in the JGC, but decided against it bc it has been a very good car. I am also glad I didn't bc who knows if I would've had to give the dealership the Jeep and how long I would've been without a vehicle - considering they were banking on the August 7th fix allowing them to release our ST to us.
This is indeed good news. I am wondering, before this did your dealer give you an estimated arrival date at dealership? My dealer told me week and 1/2 ago that they are expecting mine to be delivered to dealer 8-24-8-31. I am skeptical of these dates, but your post gives some hope for some future good news.
I'm hoping mine is right behind yours!
My dealer did say that the car was picked up from storage and brought back to the factory.
Sounds like they may be working on the fix. He's thinking it should ship like Mid Sept.
I mean how much longer can this go on for? This was ridiculous in June now it's just absurd.
